Welcome to AuraWall, These Terms and Conditions ("Terms") govern your access to and use of the AuraWall mobile application (the "App"), our website, and all related services (collectively, the "Services").
By downloading, installing, accessing, or using AuraWall, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Services.
1. Eligibility
By using the Services, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have reviewed these Terms with your parent or legal guardian and that they agree to these Terms on your behalf.
2. Account Registration and Security
* Account Creation: You may be required to create an account to access certain features of the App. You agree to provide accurate, current, and complete information during the registration process.
* Responsibility: You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.
* Notification: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. Privacy Policy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the Services, you agree to the collection and use of data as described in the Privacy Policy.
4. License and Use Restrictions
* Limited License: AuraWall grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your mobile device for your personal, non-commercial use, strictly in accordance with these Terms.
* Prohibited Conduct: You agree NOT to:
* Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
* Modify, adapt, or create derivative works based upon the App.
* Sublicense, lease, rent, loan, redistribute, or use the App for commercial purposes without our prior written consent.
* Use the App in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms.
* Upload, post, or transmit any content that is harmful, offensive, illegal, defamatory, or violates the rights of third parties.
* Use any automated means (including bots, scrapers, or scripts) to access or use the Services.
* Attempt to bypass or interfere with the security features of the App.
5. Content and Intellectual Property
* AuraWall Content: All content provided through the Services, including text, graphics, images, logos, designs, wallpapers, and software (excluding User Content), is the property of AuraWall or its licensors and is protected by copyright, trademark, and other intellectual property laws.
* Use of Content: Wallpapers provided through the App are licensed to you for personal, non-commercial use as a background on your device. You may not distribute, redistribute, resell, or publicly display these wallpapers without explicit permission from AuraWall.
* Trademarks: The "AuraWall" name and logo are trademarks of AuraWall. You may not use them without our prior written permission.
* User Content: If the Services allow you to upload or post content (e.g., reviews, profile picture, or custom images), you retain ownership of that content. However, by uploading it, you grant AuraWall a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, and distribute that content for any purpose. You are solely responsible for your User Content and confirm that you have all necessary rights to grant this license.
6. Purchases, Payments, and Cancellations (If Applicable)
* Purchases: The App may offer digital content, features, or subscriptions for purchase ("In-App Purchases"). All purchases are final and non-refundable, except as required by applicable law or as outlined in our Refund and Return Policy.
* Payment Processing: In-App Purchases are processed through the respective app store (e.g., Apple App Store, Google Play Store) or a designated payment processor. You agree to comply with the terms of that third party. AuraWall does not store your credit card information.
* Subscriptions: If you purchase a subscription, it will automatically renew at the end of the subscription period at the current price, unless you cancel it before the renewal date. You must cancel the subscription through the settings on your device (App Store or Play Store subscriptions).
7. Termination
We may terminate or suspend your access to the Services, or any part thereof, at any time, with or without notice, for any reason, including if you violate these Terms. Upon termination, your license to use the App will cease, and you must destroy all copies of the App in your possession.
8. Disclaimers
* "As Is" Basis: The Services and all content therein are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.
* No Guarantee: AuraWall does not guarantee that the Services will be uninterrupted, error-free, free of viruses, or always available. We make no representations about the accuracy, reliability, completeness, or timeliness of the content.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall AuraWall, its affiliates, directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, whether incurred directly or indirectly, or any loss of goodwill, arising out of your access to or use of, or inability to access or use, the Services. Our total liability to you for all claims arising out of these Terms or the Services shall not exceed the amount you paid us (if any) to use the Services during the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless AuraWall and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Services or your violation of these Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., the State of California, United States], without regard to its conflict of law provisions.
